At one time I had twenty or more pairs of the famous 'American made' Model Power cigar boxcars made by LGB (I believe that it was actually Athearn who was contracted to do the production in America). The later models actually had 'Made in USA' embossed in the underbody detail. Early versions still had 'Made in Western Germany', but the embossing had been erased after moulding, using the tip of a soldering iron, leaving just a section of disfigured plastic. The car does not have the embossed 'Made in USA' but does still have the LGB and Lehmann trademarks in tact. While the brandname trademark mouldings may be easily erased, the actual body design is still copyrighted protected and not so easy to erase.

You need to brush up on what happened in that little episode between Märklin and PIKO on account of a certain ICE.

you are obviously referring to the ‘h.o.’ scaled model. From memory, the Piko model was rivet for rivet, identical to the Marklin model. While hardly surprising if both are accurate scale models, I do not recall the result of legal action taken out against Piko.
The eBay clearance site for a well known distributor, has several beautiful ‘h.o.’ scaled ICE train sets from Piko. I am so tempted as the design is simply superb.

Märklin sued, Märklin lost, the judge ruled that if it was supposed to be a scale model, it couldn’t but be identical. :lol: :lol:
Märklin won’t be infringing any of the Patentwerk patents, they acquired whatever applies to a particular item when they got the moulds etc. etc.
Soooooooo even though the PIKO defense couldn’t be used - it is known that scale and LGB have a somewhat estranged relationship - little to worry on that account.
PS But there is another wrinkle, what are the chances that Märklin would appoint a distributor with a close PIKO relationship as the NA rep??

Marklin did contract with Walthers to handle their non-LGB products. They also handle competing products. I think that there is too much acrimony between Marklin and LGBoA for them to work together.

Do I send it to Europe or pay $200 to LGB Silvergate or who ever in the USA to do it. Will it endup costing me as much to do it at Marklin in Germany or for free. That is all I’m wondering. I need advice and I know there’s plenty of that here ,good and bad.Honestly I do not know what is best.

Silvergate is not LGB. LGB of America is -for all intents and purposes - Closed.
Your only option would be to send it to Märklin but I seriously doubt they would have the parts to fix it.

You have to decide how urgent it is, getting gears for the Stainz won’t be a problem. The Mike …??? It depends how many parts they kept back for that French version. Despite what some people think, the Mike wasn’t a NA eXclusive.
