LGB: Will it end up buying what it already owns?

Jack Barton said:
Bob,

In this case the Judge and the trustee are two different people. The buyer didn’t “back out”, he couldn’t come up with the promised money. I think that leaves one empty handed in any transaction.

Jack

The buyer claims to have “been hung out to dry” by his co-investors.
What we don’t know as yet is;

  1. Who were those co-investors?
  2. Why did they (allegedly) hang him out to dry?

JJ has made some (so far unsubstantiated) claims as to the identity of those partners and offered an opinion (also so far unsubstantiated), as to why.

Very dangerous ground to be walking on without irrefutable proof.

Hans-Joerg,

The reason I ask those questions was

a) this has been going on for a long time!!

b) can not remember a bankruptcies that the buyer backed out after the judge (trustee) said it is yours…

c) remember the Rock Island did…

Bob,

There have been occasions of high bidders declining, most often cases where the goods received did not match the goods the buyer bid on.
Doesn’t appear to be the case with this insolvency, but it is interesting that the question of the insolvency trustee’s savvy/thoroughness has been raised.

Let’s see what gets sorted at the start of the week, if anything!

Most of us don’t.

It’s just a matter of asking the right questions. Amazing what questions start surfacing in Germany!!

OK, Perry Mason, but don’t lead the witnesses or you might find the trouble you seek so often.

Remember, the current attention is towards the problem at hand…but once that action is complete…the focus will shift.

Do what you want, because it does not matter to me. I am just a bystander along the edge of the rail sittin’ by the water tank just waitin’ for a train.

Again, I got no dog in this fight…

Well, in some instances it doesn’t take seeking trouble, the trouble is as plain as day. Open eyes and open ears is all it takes.

Which reminds me of that old feminist saying :“Guess why men have two ears and two eyes but only one mouth!?!”

BTW this may sound strange, but I have never been suspected of dumpster diving or anything else remotely related.

OTOH there are people who don’t like it when I ask questions. Or make comments at town council meetings, such as at the end of my bit at a public hearing: “The most important test with any endeavor is … the smell test!”

Guess what played the next day on the six o’ clock News in the Valley. Poor politicos!  What they need is better publicists who can put a “better spin” on things!

Dumpster Diving…Yes, ha ha…that was funny!

I hope you can find humour…when they play “De Guello” for you.

So Rave On, Dude!

Ahhh, yes, Davy Crockett’s favorite song.

Play it, Sam. You played it for him, play it for me. (Paraphrased.)

Yes, I’m just trying to let the posters know that others in the past have been put on the carpet for statements that they made. The guys that have been around the hobby for more than 15 years know what I saying is true.

I’m only suggesting caution…but it’s no skin off my back, if they disregard.

Why doesn't Hans-Jörg give Schöntag a call and ask him?

Repeating questions over and over again doesn’t make them any more valid or pertinent.

Hmmmmmmmmmmm … now there is an idea!

Goes something like this:

HJ: “Hello Mr. Schöntag, how are you. My name is Mueller, Hans-Joerg Mueller and I have a burning curiosity to find out who those renegade partners of yours are.”

HSch: “???”

HJ: " Yes, I understand that, it was just such a disappointment that you didn’t mention their names to Gregor Le Claire"

HSch: “???”

HJ: “Yes, the reporter from the Nürnberger Nachrichten”

HSch: “???”

HJ: “Oh, that is quite understandable, I thank you for your time”

Of course it will be interesting to find out and it is very pertinent to the EPL Saga. As someone quipped on another forum: (I’m paraphrasing) One could write a book and call it “The Kollektor’s Code”.

BTW Jack, does it bother you that so many are asking the same questions? And that it seems like every day there are a few more who ask those same questions?

I don't think "bother" is the word I would use, tiresome possibly? Aren't they repeated 2,3 and 4 times per topic?

Don’t you mean ECHO YOUR questions? Do you mean the German magazine that you work and translate for? Do you mean “Otter 1” of the GBF, a.k.a. The German HJ? Do you mean your friends on other fora, where you are uninvited? Please note that these are only questions, not statements.

I got the msg loud and clear, just trying to reinforce it. I suspect that these guys can play hardball when they want to, which is why I have no opinion. I just sit back and watch the fun.

Jack.

It seems some journalists and the banks are starting to ask awkward questions concerning this saga.
You would like to see the truth come out, wouldn’t you?

You know. The truth, the whole truth, and nothing but the truth.

If JJ is rash enough to publish his opinion here, that is his business. Who am I to argue with him?

Might I respectfully suggest that you sit back, relax, and wait for the court(s) to decide the outcome.

Are you suing someone? This is the first I have heard of a law suit? Are the parties in print?

Jack,

Isn’t there a saying “That’s worth repeating!”?

Nah, I didn’t mean any of those.  Cast your glance a bit farther afield. And as far as my friends go, [a] all of my friends[/b] are quite capable to do their own thinking.  A most refreshing quality, which I appreciate in all of my friends.

Now now Jack.
A not very clever attempt at a witticism that does your image of perspicacity no good at all.

I know you know about the LGB situation currently before the Insolvency court?
Those places of erudition that often decide the outcome of financially mismanaged businesses.

Never mind any other court that might decide to take an interest in the past and current proceedings.

Jack,

You must have missed part of the story …

But Dr. Steffen Goede has been appointed as the insolvency trustee by

"Amtsgericht Nürnberg

  • Insolvenzgericht -"

That translates as

Administrative (District) Court Nürnberg - Insolvency Court

PS In Switzerland such matters are handled by the “Konkursamt” (Bankruptcy Department)

PPS “Wo ein Gericht, da auch ein Richter” (let Google translate!)

I'm very sorry. I am aware of the Insolvency Court. I think it was the "court(s)" that confused me.

Thank you very much HJ! I don’t think I would have understood that clearly without your excellent translation. As I said above, I think it was the implication of there being more than one court involved that confused me and possibly other readers.

Understood Jack. I was always taught that using the word written like that, ie having the (s) in parenthesis after "court", means, although not actually plural in that instance, it could be court or courts (plural) as the case may be in the future.
