SNIP We shall see how the mop flops...as I said earlier. Watching this unfold might be almost as much fun as playing with trains :/
Remember the reason the banks called the loan in the first place?
I’ve said it before, what was on the invoice and what was in the bag when you got home don’t seem to be matching.
Still going to be interesting to watch this unfold and the continuous “spin” by those who persist will go on ad infinitum nauseum.
Yeah, there is a WHOLE lot more to this, but like others, until it’s in print to refer to, with the legal beagles sniffing around, you don’t put squat in print.
Not even e-mails.

Now, we know the rest of the story...don't we?Not so fast, the sun hasn’t set on this deal. It’s back to the insolvency court and I have a hunch - you heard and read of my hunches, haven’t you? - that the going will now get very interesting.
And you still don’t have the “facts” that I’ve had for two months…So yodel away…Tee…Hee
Marvin,
The difference between you having the facts and me having the facts is:
a) I like to have my facts backed up by real documentation
b) you delight in relying on “reliable sources”, which I can’t afford to do since I can’t afford to look as foolish as some people have in the recent past.
If I would take whatever I hear, get fed and read from “reliable sources” and would base my posts on that then I would look just as silly as certain people I know and I would probably not hear again from the people who provide real info that can be verified.
That’s the basic difference.
PS I do have a handicap; I was never a spook!

From Tony Castellano, President of LGB of America posted on the garden Railways page "We learned today that Mr. Schöntag, the announced buyer of E.P. Lehmann, has been unable to secure bank financing to complete the purchase. Although we believe that another buyer or investor will be found, this is an extremely difficult situation for our many friends at Lehmann, and we wish them all the best"
Mik,
It will be interesting to find out if Hermann Schöntag considers Castellano’s statement defamatory, libelous or slanderous. There are provisions in German law for each and since Hermann Schöntag announced looking for (legal?) remedies for certain statements, I wonder if he’ll add the opening sentence of Castellano’s announcement to the list.
More stuff coming down the pipe.
PS I’m keeping my eyes peeled for the first official notices in the German press.

Wasn’t said in Germany…so German Laws do not apply.
Well you are correct about more coming…but what of that Aristo-Bachmann Euro Diesel…Hmmmm?
Oh and you might, maybe, sorta kinda see a very nice sale on LGB Euro Style Trains in the U.S. soon. But I really don’t want you to assume anything that you might not see printed or shoved under your nose…at least until it is!
Well, seems several were prosecuted over something that isn’t illegal here.
Something about involvment with a Party some time ago?
Or lettering rolling stock for said regime?
Bottom line shall be, since the “transfer” took place on what, a Monday, the Banks called the loan on a Friday, and proctection from the Courts was sought the following Monday, wasn’t it? the issue is the “transfer”.
I ain’t gonna put it in print, but one needs to understand WHY the banks called the loan when they did, and then one needs to find out exactly what was on the “deed of sale”.
Another thing to find out is what was on the list of assets the bank held for the loan collateral…
My guess right now is that this is a game being played out over there.
Somebody doesn’t want to pay lawyers to sort it out, and if the sale is to stand, the banks and courts are going to have to sort it out.
It ain’t over with yet, but that’s just a guess.
Marvin, all the speculation would be put aside if we knew who actually owned G45, who provided the money to set it up and purchase all the “rights” it has, where the money so provided went when the “rights” were purchased, and did the insolvency trustees know such “rights” had been sold during the insolvency proceedings?
The true answers to those questions may very well fall under the jurisdiction of the German courts.
You claim to be in the know so how about letting us all in on the information?

Tony,
Good one!
You mean without any “reliable source” references? What are the chances? Nil to sub-zero to absolutely negative?

Marvin, You gotta set aside your rage! If and when there’s a Euro LGB sale in the USA, I’m sure I’ll hear soon enough to get a few “choice” items. I just don’t get quite as excited as some others. Long term plans and all that good stuff, eh! BTW my well-being doesn’t stand or fall with what RhB stuff I can get from LGB. Just like I did in HOm I can bash stuff from what some consider most unlikely sources. Lot’s of fun, too! And one day there will be pictures.

Rolf Richter attended Law School, may have practiced law before he was forced, due to his Father’s age & health, to take over the EPL business. He conducts no transactions personally, (the days of the hand shake are over). His lawyers carve out the contract and business dealings. So who had the most interest in splitting LGBoA away from EPL to escape the German Labor Laws & EPL Debt Load and using the very unique Delaware business corporation laws to do it? Thus hiding the true owner(s) of LGB?
It’s not really too difficult to answer your question now, is it?

HJ You obvisiouly have misinterpreted my words again. It seems you do it far too often…so I won’t trouble you with them much longer. My fortunes do not rise or fall on anything in the Model Train Hobby or any manufacturers/dealers products or problems, either. So ist es zu mir mox nix.

Yes indeed!
